. Banishment.

NOTE: I have removed much of this text, as Rachel was not banished, but exiled from the realm. Please see notes below.

The result: She may not attend events in the current reign.

(2) Banishment from the realm withholds recognition of the banished person's honors and titles, and bars active participation in Society events in that realm for the duration of the banishment or the reign, whichever is lesser. Banishment from the realm specifically does not preclude attendance at events, as long as the banished person makes no effort to engage in activities subject to the jurisdiction of any officer, or otherwise disrupt the peace of the event. The Society Seneschal and the Board will automatically review banishments from the realm. Such a banishment must be imposed only in response to serious transgressions against Society rules or standards of behavior at a Society event or in the course of performing official duties on behalf of the Society. If the Board determines that such a banishment is without merit or has been unfairly imposed, the banishment will be lifted and the royalty that imposed it may be subject to sanctions.

Thanks to Hamish (Dave) for the note. The specific language used on Saturday, in the announcement, as I recall, was: "Rachel Zavala, known in the SCA as Ysabella Dolphin, is level II banished." When it is published in the Kingdom newsletter, in the ...November issue, as per Corpora, we will have the exact words. I RECALLED WRONG.

Megan has stated that reasons are not given to the general populace due to the everpresent American possibility of lawsuit. She has both reigned and served as Kingdom seneschal, and has the clue. However, we should be able to see a history
of actions taken both as a problem, and to correct that problem. That history is not clear to me. Please note that I worked with Ysabella on the Esfenn Feast of the Fine Arts, and so may be considered partisan.

Please note that the opinion I am expressing is that I wish more information, directly from sources, rather than stir the witch's cauldron of rumor.

Thanks for the info, helps folks understand at least the mechanics of the issue.

No comment (here) on the implementation of said mechanics.

2. Greater Royal Sanctions
A Greater Sanction may be imposed only in response to serious transgressions against Society rules, serious violations of standards of behavior at a Society event, or other actions that negatively affect or endanger the Society. Banishment from the Realm* bars the sanctioned individual from active participation in Society events in that realm. Banishment from the realm specifically does not preclude
attendance at events, as long as the banished person makes no effort to engage in activities subject to the jurisdiction of any officer except as required for event attendance, or otherwise disrupt the peace of the event. Additionally, such a banishment carries with it the restrictions of a Banishment from the Royal Presence.
Exile from the Realm precludes the sanctioned individual from attending any SCA function in that realm.
*Emphasis mine

The sanctioned individual, Kingdom Seneschal, Society Seneschal, and appropriate Board Ombudsman must be informed in writing within ten business days of the specific cause and occasion of the sanction...
All reasonable attempts to contact the sanctioned individual must be made before imposing the sanction. Written communication must be sent via postal service to the individual's last known address, with proof of delivery required. If a valid address is unavailable, then an attempt to deliver the notification to the sanctioned individual in person, either at an event or otherwise, must be made. Failing that, if a current, valid email address is available, the notification shall be sent electronically, with some sort of delivery confirmation if possible. Every attempt to deliver notification to the sanctioned individual shall be thoroughly documented. After all available methods of contact have been exhausted, the sanction shall be announced as required.

I don't know which flavor was imposed on Herself, but I got the impression that she was caught completely unawares, which, if I'm reading this correctly, isn't following procedure. I freely admit, however, that I don't have all of the information.

The words I heard were "Banishment level two". The word sanction was to the best of my recall not in the announcement.

Hm. I'd heard "level 2 banishment and Exile from the realm." But now I'm wandering into territory I have no personal knowledge of, which can really only be unhelpful.

Regardless, though, it'll be reviewed by the BoD, and the truth will out. It all seems so sketchy from this great distance, though. I'm sorry the West is being put through this high-profile kerfuffle. :(

No, she was exiled, not banished.

Ysa was Exiled from the Realm.

I've seen the letter from the Seneschal, so that's not hearsay.

wait, is "Herself" in the previous paragraph the Queen, Ysabella or the seneschal?

Ysa. I try to err on the side of cryptic in others' journals, but since she's piped up here, I figure it's OK to spill the beans. :)

Thank you. I was wondering just what affect this had and for how long.

Actually,

From: [identity profile] learnteach.livejournal.com
It's still unclear. The big question is whether Ysa will be autocratting the West/An Tir war next year. At this point the Royalty could have someone else autocrat. But I don't know if she's autocrat of record for it.

In real terms, it just means she has to avoid the Royalty, and can't hold office or title, which limits her...very little.

Sounds like at worst it would last until 12th night, which would impede communications about west/AnTir portapotties and such. It would be nice if the BoD could have a conference call real soon and sort this out. Given that none of us knows of any action on Ysa's part that is so egregious as to merit exile, I would be very surprised indeed if the proclamation was upheld.

It also means that she can not finish her effort to compete in the Kingdom Arts and Sciences Championship. She has been one of the three people competing this year, and now all that effort is for naught.

As of right this minute, there's no reason that she can't autocrat the war next year.

2. Greater Royal Sanctions
A Greater Sanction may be imposed only in response to serious transgressions against Society rules, serious
violations of standards of behavior at a Society event, or other actions that negatively affect or endanger the
Society. These Sanctions continue for the stated duration of the Sanction or until the end of the reign,
whichever comes first.
Greater Sanctions imposed by the Royalty of a Principality require prior written approval by the Crown, and
may be lifted by the Crown. Greater Sanctions are:
• Withdrawal of the Privileges of Rank precludes the sanctioned individual from exercising
any privileges of rank in the realm of the issuing Royalty. This includes, but is not limited to,
peerage polling privileges, as well as the use of associated titles and regalia.
• Banishment from the Realm bars the sanctioned individual from active participation in
Society events in that realm. Banishment from the realm specifically does not preclude
attendance at events, as long as the banished person makes no effort to engage in activities
subject to the jurisdiction of any officer except as required for event attendance, or otherwise
disrupt the peace of the event. Additionally, such a banishment carries with it the
restrictions of a Banishment from the Royal Presence.
• Exile from the Realm precludes the sanctioned individual from attending any SCA
function in that realm.
• Absolute Banishment precludes the sanctioned individual from attending any SCA
function in any realm. In addition to the general requirements for Greater Sanctions, an
Absolute Banishment may only be imposed when grounds for a Revocation and Denial of
Membership exist. An Absolute Banishment automatically carries with it a request

Thanks!

The length of a Exile from the Realm is the Balance of the Reign of the Royalty imposing it. So in this case 1/2 way through 12th Night.

The only Banishment's that can last longer are R&D's (used to be called Level 3), after the Board has reviewed them.

*sigh*

I do not have information as to the specifics, nor such corrective actions as were attempted prior to the writ of exile, and that was the word used. I know that both the Kingdom Senechal and the Senechal were in the loop prior to the action being taken.

The term of such banishments (I will use the older form for my own comfort) is always at the maximum until the current Crown's reign ends, although I have seen them continued from Reign to reign.

Personally I believe that there needs to be a path for resolution of the matter. However at this point it will require a person or persons with no dog in the race to act as intermediaries.

One other point. I think it is unbalanced, but the Crown has been told to remain silent on the issues, but the SCA does not also restrict the person sanctioned from sharing any and all communications that they have received. If she wishes to do so of course.
